INRIX™ PRIVACY POLICY

1. WELCOME

This privacy policy (as modified from time to time, the “Inrix Privacy Policy”) explains how your personal information is processed and used by Inrix, Inc., a Delaware corporation (“Inrix”), and others when you visit or use the Inrix websites at www.inrix.com and/or mobile.inrix.com (the “Inrix Websites”), or register or use any of the services described in the related “Inrix Terms of Use”, as modified from time to time on the Inrix Websites (the “Inrix Terms of Use”).

This Inrix Privacy Policy informs you of the personal information that Inrix may collect about you, how we collect it, what we do with that information, and with whom we share it. Your use of the Inrix Websites or any of the Inrix services described in the Inrix Terms of Use (the “Inrix Services”) is subject to your agreement to this Inrix Privacy Policy and the Inrix Terms of Use, of which this policy is a part.

Please enjoy the Inrix Services, and read this Inrix Privacy Policy carefully before accessing or using any part of those services or the Inrix Websites. By accessing or using either from time to time, or by accepting the Inrix Terms of Use, you agree to be bound by all the Inrix Terms of Use, as modified by Inrix from time to time and set forth on the Inrix Websites, including without limitation the provisions of this Inrix Privacy Policy. Users should review such modifications by Inrix, as any use of the Inrix Services or of the Inrix Websites constitutes ongoing acceptance of all then-existing modifications.

2. INFORMATION COLLECTED

Inrix seeks to provide high levels of personalized service, while also respecting your privacy. In order to do this, we collect and store information that will help us personalize the service we provide. If obtained by Inrix as part of any registration process for use of the Inrix Services, Inrix holds your name, email address and other registration information in order to provide you with the applicable Inrix Services. To help provide you with specialized needs, we may collect information about your use of the Inrix Services. If you use our Inrix Traffic for Windows Mobile service, we may in the future process location information of a user in order to provide a more useful service for you and other Inrix customers. We also collate generic information on all our users (so that no individual user is identified) to help us develop a better service.

3. USE OF REGISTRATION INFORMATION

We use your name, email address and other registration information to provide you with the applicable Inrix Services. This means that Inrix processes your data to allow you to do such things as access the Inrix Services, or to communicate with you generally. This includes using your data for audits and business planning purposes. We also may process the information about an individual user’s frequency and nature of use of the service provided so that we can profile your individual use of the Inrix Services. This allows us to enhance our service to you by directing specialised information and services to you that may be of interest.

4. USE OF YOUR INFORMATION BY THIRD PARTIES

Inrix does not sell or otherwise share personally identifiable information with third parties except in the following instances: (1) unless required by applicable law or pursuant to a court or similar order; (2) as deemed necessary, in Inrix’ sole discretion, to protect the legal rights or the property of Inrix, a user of the Inrix Services or any third party; to operate the Inrix Services properly; or to prevent personal injury or loss; or (3) in the event Inrix is required to transfer personally identifiable information to a third party as part of a sale, merger, assignment, joint venture or other transfer or disposition of a portion or all of the assets or stock or Inrix or its affiliated entities. In addition, your personal information may be shared with our alliance and service companies (and licensors) who help provide support, data, technology and services to Inrix, such as vendors, suppliers and communication providers, in order that it may be used to provide you with the applicable service. We will seek to provide that all such shared information is not further transferred, and that it is used only to provide you with enhanced services or information. Inrix reserves the right to provide aggregate data (where no individual user is identified) to third parties for statistical analysis, including information that is derived from voluntary customer surveys.

5. USE OF COOKIES AND CLICK-TRAILS

A cookie is a small file that is sent to your browser and stored on your computer. It allows Inrix to identify you when you use the Inrix Websites or the Inrix Services, and it contains such details of your name, address, user code and password. We store this information in the cookie and use it as a means of identifying you when you use the Inrix Services, and in order to offer you personalised services and profile your use of the Inrix Services. It means that you do not need to type in your user name and password each time you return to our service. To direct you to other sites that may be of interest or to provide you with improved services in the future, we use click trails. These allow us to assess the popularity of sites and web pages visited by our users.

6. PROTECTION OF YOUR PERSONAL INFORMATION

Your personal registration information is protected by your registration password, so that others cannot access it. You should keep your Inrix password secret and avoid writing it down or storing it on your computer. When you have finished a session using any of the Inrix Services, always remember to log off so that others cannot use your computer with your account details. Inrix’ internal policies help ensure that your personal information is treated with appropriate security where possible. However, the nature of the Internet and wireless networks means that the transmission or maintenance of your data cannot be guaranteed as secret.

7. TERMS OF USE AND REVISIONS

If you use or attempt to use the Inrix Services, such use or attempted use, as well as any dispute over privacy, shall be subject to the terms of the Inrix Terms of Use, including the limitations of liability, compulsory arbitration and governing law provisions of those Inrix Terms of Use. Because Inrix' business changes constantly, Inrix reserves the right, at its sole discretion, to modify this Inrix Privacy Policy and the Inrix Terms of Use of which such Privacy Policy is a part, at any time without notice of any kind, and such modifications shall be effective upon posting of the modified Inrix Privacy Policy or modified Inrix Terms of Use on the Inrix Websites or any related site. You shall be deemed to accept such modified policy and the Inrix Terms of Use by continuing access, or use of, the Inrix Services on or after the date of modification.

8. YOUR CONSENT

By accessing or using the Inrix Services, or accepting the terms of Inrix Terms of Use which incorporate this policy, as modified from time to time on the Inrix Websites, you consent to the collection and use of this information by Inrix for the purposes described in this Privacy Policy. Your use of the Inrix Services is subject to your agreement to this Privacy Policy and to the Inrix Terms of Use, which incorporate this Privacy Policy.
